Will Your Site Require Advanced Treatment?
This is the question behind most Alabama septic sticker shock. Rule 420-3-1-.25 lists specific site conditions that require advanced treatment — and an advanced treatment system typically costs roughly double a conventional one. The conditions are checkable, so you can get a sense of your exposure before anyone quotes you.

The Rule
Ala. Admin. Code r. 420-3-1-.25, Advanced Treatment Required, states that the following systems, sites and conditions shall require advanced treatment:

Why Too-Fast Percolation Is a Problem
Subsection (e) surprises people. Soil that drains quickly sounds ideal — and for a driveway it would be.
But a drain field treats wastewater by giving it contact time with soil, where bacteria break down remaining contaminants. Where water moves faster than 5 minutes per inch, effluent reaches groundwater before adequate treatment has occurred. Very sandy sites can fail for the opposite reason to clay sites, and get the same expensive answer.
Why Clay Is a Problem
Subsection (f) is the Black Belt story, and the regulation connects the dots itself.
Rule 420-3-1-.04 defines high shrink-swell soils as soils with relatively high clay content and a dominant mineral such as montmorillonite, a member of the smectite family — and describes them as “inherently slowly or very slowly permeable.”
Slow permeability means a high percolation rate in minutes per inch. Cross 240 MPI and advanced treatment is required. That’s the chain from soil mineralogy to a doubled quote, and it’s all in the code.

The Mine Spoil Trigger
Subsection (g) is the one almost nobody knows about, and it’s uniquely Alabama.
Where mine spoil sits at the natural ground surface to a depth of at least 48 inches within the proposed disposal field area, advanced treatment is required. Full stop — regardless of how the soil otherwise behaves.
Alabama has extensive historic coal mining across Walker, Jefferson, Tuscaloosa, Cullman, Blount and surrounding counties. Land strip-mined decades ago is often pasture or woodland today, and a buyer has no particular reason to know.

Who Has to Design It
ADPH states that only registered engineers may design systems where the soil percolation rate exceeds 60 minutes, or on locations with a shallow limiting zone such as groundwater, clay or bedrock.
Note that 60-minute threshold is well below the 240 MPI advanced treatment trigger. So there’s a middle band — between 60 and 240 MPI — where you don’t necessarily need advanced treatment but you do need an engineer to design the system.
Separately, 420-3-1-.04(36) defines an Engineered OSS to include any system with a septic tank followed by a disposal field where any portion of the field protrudes above the unaltered natural soil surface. If the design requires fill or a mound, engineer design follows automatically.
What This Means Practically
If you’re buying land: get a soil and site evaluation before you close. The difference between conventional and advanced treatment is roughly the cost of a used car, and it’s determined by conditions you can’t assess by walking the property.
If you’re replacing a system: the evaluation applies today’s rules, not the ones in force when the original went in. A site that supported a conventional system in 1985 may not now.
If you’ve had a quote that shocked you: ask which subsection of 420-3-1-.25 applies. It’s a fair question, and a competent installer or engineer will answer it directly.
