Alabama Septic Regulations (Chapter 420-3-1) Explained

Quick answer: Alabama septic systems are governed by Ala. Admin. Code Chapter 420-3-1, Onsite Sewage Treatment and Disposal, written by ADPH and enforced through county health departments. Installers are licensed separately by the Alabama Onsite Wastewater Board. The rules are unusually specific about soil conditions, which is why they drive cost so directly.

The Terminology

Alabama’s rules use their own vocabulary, and it’s worth translating up front.

OSS — Onsite Sewage Treatment and Disposal System. What most people call a septic system. Defined as a system that collects, transports, treats and provides subsurface disposal of sewage from establishments or dwellings.

EDF — Effluent Disposal Field. The drain field. Defined as a minimum area, calculated per the rules, into which sewage treated to at least primary effluent standards is dispersed into the soil.

Small-Flow OSS — a system with an average daily design flow of 1,800 gpd or less, or serving 12 bedrooms or fewer. That covers essentially all residential systems.

Responsible person — for a private dwelling, the property owner or their authorized agent. The person who signs the permit application.

Conventional vs. Engineered

This distinction drives cost more than any other, and the definition is precise.

Under 420-3-1-.04(36), an Engineered OSS means all systems other than those meeting the definition of Conventional OSS, that require engineer design. The rule lists, without limitation:

Controlled fill mound systems · advanced treatment (except proprietary advanced treatment followed by a conventional EDF) · drip irrigation · low pressure pipe (LPP) · non-proprietary uniform distribution · constructed wetlands · and systems with a septic tank followed by an EDF where any portion of the EDF protrudes above the unaltered natural soil surface.

That final clause is worth pausing on. If any part of your disposal field sits above natural grade, it’s engineered by definition. Fill or a mound means engineer design, regardless of how the soil performs.

The Soil Conditions That Drive Everything

Rule 420-3-1-.25 lists the conditions requiring advanced treatment: shallow bedrock under 12 inches, percolation slower than 240 MPI or faster than 5 MPI, seasonal saturation within 6 inches, mine spoil to 48 inches, plus pad or bed construction and drip irrigation.

Separately, ADPH permits only registered engineers to design systems where percolation exceeds 60 minutes or where there’s a shallow limiting zone such as groundwater, clay or bedrock.

Permits

Under 420-3-1-.06, a Permit to Install (Repair) is required before beginning installation or repair of a system or any component of one. ADPH may revoke it where lot conditions change, the system isn’t installed per the permit, or submitted information proves misrepresented, materially false or inaccurate.

Approval for Use follows, issued by the local health department after all conditions of the rules and permits are satisfied.

Technical Standards Worth Knowing

Aggregate. Under 420-3-1-.04(6), drain media must be hard, clean gravel or rock washed under pressure over a screen, with a hardness of 3 or greater on the Mohs scale. The rule’s own illustration: aggregate that can scratch a copper penny without leaving residual rock material on the coin. Properly sized loose aggregate runs from 1/4 inch minimum to 2.5 inches maximum. It must be durable and inert, maintain its integrity without collapsing or disintegrating, generate no harmful leachate, and not be detrimental to the system or environment.

Effluent filter. ADPH’s installer certification requires an NSF Standard 46 effluent filter installed.

Observation pits. Minimum 3 feet wide, 60 inches deep unless hard bedrock is encountered, safely accessible, parallel to the contour, and level.

Setbacks. Reported requirements put the effluent disposal field at least 100 feet from a private well or potable spring, and at least 5 feet from a property line.

Setback figures come from a secondary source. Confirm current distances with your county health department before relying on them for a specific project.

Installer Licensing

Handled by the Alabama Onsite Wastewater Board under Chapter 628-X-3, separately from ADPH. Tiers run Basic, Advanced Level I, and Advanced Level II, plus a Manufacturer’s License.

Advanced Level II covers everything under the lower tiers plus installation, servicing, lid replacement, repair and maintenance of all onsite wastewater systems permitted by ADPH — including effluent discharge systems, large flow systems, multiple pump systems with timed dosing, and other advanced technology systems, as well as cluster wastewater systems and community systems holding UIC permits from ADEM.

Homeowner installation is not permitted in Alabama.
