What the Regulation Actually Says

Alabama defines these soils precisely. Under 420-3-1-.04(48):

High Shrink-Swell Soils — soils that have relatively high clay content and a dominant mineral type that causes significant swelling when wet and shrinking when dry such as montmorillonite, which is a member of the smectite family. These soils are inherently slowly or very slowly permeable. Most Vertisols and Vertic Intergrades have a high shrink-swell potential. COLEs (Coefficient of Linear Extensibility) are usually greater than or equal to 0.09.

And 420-3-1-.04(122) defines smectitic as a group of clay minerals, including montmorillonite, that cause soils to exhibit a high degree of shrinking and swelling when it’s the dominant clay mineral.

Why This Matters for Septic

A drain field works by letting effluent percolate down through soil at a manageable rate. Too slow, and effluent has nowhere to go — it backs up, saturates the field, and eventually surfaces.

Smectitic clay is slow by nature. Then the shrink-swell behavior makes it worse in a specific way: when the soil is wet, the clay swells and the pore spaces close further. So the soil is least permeable exactly when the system most needs it to drain.

The Engineer Threshold Comes Sooner

ADPH permits only registered engineers to design systems where the soil percolation rate exceeds 60 minutes, or on locations with a shallow limiting zone such as groundwater, clay or bedrock.

So there’s a band between 60 and 240 MPI where you don’t necessarily need advanced treatment, but you do need an engineer designing the system. Plenty of Black Belt sites land there, and engineering is a real cost even when treatment isn’t required.

Living With Shrink-Swell Soil

If you already have a working system on these soils, a few things matter more than they would elsewhere.

Water management is critical. Your field has less margin than one on well-draining soil. Spacing laundry across the week, fixing running toilets promptly, and being deliberate about heavy water use genuinely helps.

Keep runoff away. Roof and driveway drainage reaching the field adds load the system was never sized for, and on slow soil there’s nowhere for it to go.

Pump on schedule, and err short. Solids reaching a field on slow soil do more damage than they would on sand, because the field has less capacity to recover.

Expect seasonal variation. A system on shrink-swell clay may perform noticeably better in dry months than wet ones. That’s the soil, not necessarily a fault — but persistent wetness plus odor is a different matter.
